Appendix 1 Perkbox Recognition Additional Features terms and conditions

1. Special Terms applicable to Perkbox Recognition Additional Features (“the Features’) only. This appendix forms part of and is subject to the terms and conditions of the Perkbox Standard Terms and Conditions of Supply. Words and phrases defined in the Perkbox Standard Terms and Conditions of Supply shall be given the same meaning in this Appendix except where stated.

1.1 The Features is an additional feature to the Perkbox Recognition Programme which allows the Customer to create and use a balance from which to provide credits or Perks to their employees who are also End Users of the Perkbox Platform.

1.1.1 The Customer may hold either Admin or Manager access. Admin access allows the Customer to add credits to the Features via bank transfer or credit card. Customers with Admin access may then allocate credits to Managers who can then provide credits or Perks to their employees who are also End Users of the Perkbox Platform.

1.2 The Customer agrees and acknowledges:

1.2.1 That use of the Features constitutes acceptances of these terms. Any other Programmes not related to the Features are subject to the relevant Perkbox Standard Terms and Conditions of Supply or Perkbox End User Terms and Conditions as applicable.

1.2.2 Perkbox may amend these terms from time to time. We recommend that you check these terms periodically to ensure you understand the terms that apply at the time. These are available in the Help Section on the Perkbox Platform.

1.2.3 We may update and change the Features from time to time to reflect the changes to the functionality of the Features, the needs of our users, our business practices and for reasons related to changes in laws and regulations. We will try to give you reasonable notice of any major changes.

1.3 Registration and Access

1.3.1 The Features is only available to the Customer and registered End Users of the Perkbox Platform. We rely on the details provided by the Customer of their employees who are also End Users. So please take the time to ensure these are accurate and complete. You must notify us as soon as possible of any changes to this information.

1.3.2 We require Two Factor Authentication for the verification of Customers with Admin or Manager access which requires the inputting of a mobile phone number to verify the identity of the Customer.

1.3.3 You will ensure that your authorized users will at all times keep their log-in information confidential and will not allow anyone else to use their personal log-in details. We have the right to disable any user identification code or password, at any time, if in our reasonable opinion that End User has failed to keep their personal log-in details secure.

1.3.4 We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

1.4 The Features Balance

1.4.1 You are able to top up the Features Balance via two means

1.4.2 The Admin may load credits into the Features via Credit Card. These credits may then be allocated to Managers. The credits will appear immediately in the Features after payment has been made.

1.4.3 The Admin may load credits into the Features via bank transfer. The credits will appear in the Features 3-5 working days after payment has been made.

1.4.4 Perkbox reserves the right to reclaim or make balance adjustments accordingly where it has been established that the Features Balance has been applied in error. This will include but is not limited to transactions where the balance has not been paid by the Customer and/or where Perkbox has incorrectly applied the balance This can include transactions which are already marked as “payable” in your account.

1.5 Tax Liability

1.5.1 You are responsible for any tax liability or implications that may arise out of or in connection with your use of the Features. Perkbox does not provide any advice in respect of this and we disclaim all liability for advice to the extent we are lawfully able to do so.

1.6 Fraud Prevention

1.6.1 We have the right to deactivate your account if you breach any of these terms, or if your account is used in connection with fraudulent activity. We may also deactivate your account if we suspect that the security of your account has been compromised.

1.6.2 We reserve the right to deactivate dormant accounts which have not been used for at least 6 months. Please log in to your account once every six months to prevent such deactivation.

1.6.3 Upon deactivation of your account for any reason, any balance will be forfeited and you will no longer have access to the historical data on your account.

1.7 Refunds

1.7.1 Perkbox will not in any circumstances whatsoever provide any refunds in respect of balances loaded by the Customer to the Features and you expressly and irrevocably waive any right to reclaim any amounts represented by the balances.

1.7.2 Any credits or Perks that is allocated by an Admin or Manager to an End User is non-refundable and you expressly and irrevocably waive any right to reclaim any amounts allocated to an End User.

1.7.3 On termination of the Perkbox Terms and Conditions of Supply, the balance of the Features is forfeited.

1.8 Dispute Process

1.8.1 If you wish to raise a dispute, you must raise this with your account manager or admin support first.
